Terms of Service

1. Introduction
These terms govern your use of Herron ("the Service"), a browser-based tile and flooring layout planner available at herron.app. By using the Service, you agree to these terms. If you do not agree, please do not use the Service.
Herron is operated from the United Kingdom. These terms are governed by the laws of England and Wales.
2. The Service
Herron provides tools for planning tile and flooring layouts, estimating material quantities, generating cut lists, and exporting PDF cut sheets. The free tier lets you draw surfaces, configure tiles, and preview layouts. Paid features (PDF export) are available via one-time payment per project.
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will make reasonable efforts to notify you of material changes.
3. Accuracy disclaimer
Herron is a planning and estimation tool. All measurements, cut lists, material quantities, and layout previews generated by the Service are estimates only.
You must always verify measurements on site before purchasing materials or beginning any installation work. Real-world conditions — including surface irregularities, walls that are not perfectly straight, manufacturing tolerances in tile dimensions, and required expansion gaps — may cause actual requirements to differ from the estimates provided.
Herron does not guarantee that the layouts, cut lists, or material estimates are error-free. You use the output of the Service at your own risk and should always apply professional judgement when making purchasing and installation decisions.
4. Your data
Project data (floor plans, tile configurations, layouts) is stored in your browser's localStorage. You are responsible for your own data. We cannot access, recover, or restore project data if you clear your browser storage, switch devices, or lose access to your browser profile.

5. Payments and refunds
5.1 Payment processing
Paid features are processed via Stripe. By making a purchase, you agree to Stripe's terms of service. All prices are displayed in GBP and include VAT where applicable.
5.2 Digital goods and refund policy
PDF cut sheets are digital content delivered immediately upon payment. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you acknowledge that:
- Digital content delivery begins immediately after payment.
- By proceeding with payment, you consent to immediate delivery and acknowledge that you lose your right to cancel once the download or email delivery has begun.
If the PDF is not delivered due to a technical error on our part, we will either re-deliver the PDF or issue a full refund. Contact [email protected] if you experience any delivery issues.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to interfere with or disrupt the Service's infrastructure
- Reverse-engineer, decompile, or extract source code from the Service
- Use automated tools to scrape or overload the Service
- Misrepresent your identity or impersonate others
We reserve the right to restrict access to the Service if we reasonably believe these terms are being violated.
7. Intellectual property
All content, code, design, and branding of the Service is owned by Herron and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our written permission.
The layouts, cut lists, and PDFs you generate are yours to use freely for personal or commercial purposes (e.g. tiling projects, client proposals).
8. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the Service.
- Our total aggregate liability for any claim arising from or related to the Service is limited to the amount you have paid to Herron in the 12 months preceding the claim, or £50, whichever is greater.
- Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
9. Indemnification
You agree to indemnify and hold harmless Herron from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these terms.
10. Third-party services
The Service integrates with third-party providers including Stripe (payments), PostHog (analytics), Sentry (error tracking), Resend (email), and Cloudflare (hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party service providers.
11. Changes to these terms
We may update these terms from time to time. Material changes will be communicated via the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms. The "Last updated" date at the top indicates the most recent revision.
12. Governing law and disputes
These terms are governed by the laws of England and Wales. Any disputes arising from or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, nothing in these terms affects your statutory rights under UK consumer protection legislation.
13. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
